立委推動企業版「貪污治罪條例」

鴻海傳出高層幹部集體向廠商索賄醜聞，國民黨立委謝國樑今天(22號)召開記者會，認為現行民間的貪污行為，只能以「背信罪」論處，而且經常遭法院駁回、甚至獲判無罪，因此他提出「企業賄賂防制法」草案，要把民間收賄的罰則，在無須證明企業遭受損害的情況下，處以5年以下有期徒刑、拘役或併科300萬元以下罰金。　　(程平報導)

謝國樑說，如果依照他的版本完成立法，將會是國內首度將企業貪污入法，而且只要企業內部有人員收賄，不需證明企業是否有遭受損害，就可以依照情節輕重，處五年以下有期徒刑或併科最高300萬元的罰金，謝國樑說，如果不這樣做修法，類似鴻海這次的案例，就有可能以不損及鴻海獲利的訴求，獲判無罪，因此他希望朝野重視，在立院下會期儘速通過立法。

對此，出席記者會的法務部廉政署副署長楊石金表示，對於擬定這樣的專法樂觀其成，也預計會在下半年會提出「公益揭弊者保護法」草案，儘速配合立法。
