巴西反間諜監聽法案 眾院過關

為保護人民隱私免受美國間諜監聽、並保障對網路的合法連結，巴西眾議院25日通過一項突破性的反間諜監聽網路法案。

為了確保法案過關，巴西政府撤除一項迫使全球網路業者，儲存巴西國內用戶訊息的具爭議性條款。

巴西是在美國國安局(NSA)承包商前雇員史諾登(Edward Snowden)揭露的檔案指出，NSA監聽包括巴西總統羅賽芙(Dilma Rousseff)、和巴西石油公司(Petroleo Brasileiro SA)在內的巴西人民數位通訊之後，在去年針對網路管理立法提出新增這項條款。

巴西撤除這項條款，改為要求谷歌(Google)和臉書(Facebook)等業者，在涉及巴西人訊息的案件中必須遵照巴西法律，即使這些資料是在海外儲存。

不過，巴西政府拒絕就法案中，另一項針對網路中立的條款進行協商。這項條款面臨巴西電信業者的強烈反彈，因為它禁止業者根據網路的使用和速度，實施不同的定價，好比說是下載影像就提高收費。

巴西政府表示，這項被稱為巴西「網路憲法」(Internet Constitution)的立法，保護了表達自由、為隱私採取防衛措施，而且為網路用戶收集和詮釋資料(metadata)設限。
