自認被欺負 二兵擅離營判3月

〔自由時報記者何宗翰／新竹報導〕新竹縣關西鎮陸軍步兵第206旅第三營兵器連一名黃姓二兵，因為在部隊被同袍欺負，竟擅自離營，跑到新北市淡水附近以打零工為生，長達54天之久，最後被憲兵查獲，依陸海空軍刑法判刑3月，緩刑2年，罰款5萬元。

20歲黃姓二兵102年11月13日入伍，12月21日上午8點休假，休假前有登記搭乘專車回營，原應於22日晚間6點，在新竹火車站集合搭專車收假，卻因自認在軍中被欺負不敢面對，逾假不歸，在淡水附近打零工，有時也回板橋的住處躲藏。

國防部北部地方軍事法院檢察署於103年1月3日發布通緝，由新北市憲兵隊於2月14日在新北市將他查獲，逃兵近54天，案經憲兵隊報告新竹地檢署偵查後聲請簡易判決。

法官認為，黃姓二兵無任何前案紀錄，素行良好，因個人壓力適應不良，無故離去職役，查獲後也坦承犯行，考量他僅國中畢業，年輕識淺、思慮欠周詳，判緩刑2年並罰5萬元警惕。
